Jointly: The Parties
For the provision of: Counselling Sessions (the Services)
1. FORM OF AGREEMENT
This Agreement between the Counsellor and Client will begin on the date the agreement is signed by the Parties and will continue for a number of Counselling Sessions as shown in Schedule A.
The total amount per session or for the Counselling Session series will be as stated in Schedule A.
2. PAYMENT
It is agreed that the payment will be made in advance to the nominated bank account in Schedule A.
Sessions paid for in advance shall be used within a timeframe of twelve (12) months, after which, moneys paid for remaining sessions not used will be forfeited.
Cancellation of a session within the 24 hours prior to the scheduled session commencement will incur a cancellation fee of the full cost of the session. Cancellation prior to this is not charged/is refundable if prepaid.
3. THE SERVICES
The Services to be provided by the Counsellor to the Client are Counselling Sessions either in person or over the phone, which will run for approximately sixty (60) minutes. As designed jointly between the Counsellor and Client, counselling may address specific personal objects, concerns and general conditions in the Client’s personal and/or professional life.
Counselling tools may be used if the Client and the Counsellor mutually agree upon this.
4. LIABILITY
The Client agrees not to hold the Counsellor liable for any loss, damage, impact, worsening of an existing condition or appearance of any new condition incurred or perceived to be incurred by the Client, caused either directly or indirectly by the provision of the Services. The Client will not hold the Counsellor liable for any goals not achieved, perceived problems not resolved, or any effect whatsoever, be it in the opinion of the Client or any other person or entity related to the Client.
5. NOTICE
The Client and Counsellor agree to provide each other with a minimum twenty-four (24) hours’ notice if a Counselling Session cannot be attended. Should notice not be provided by the Client in the appropriate timeframe, the Counselling Session will be charged as though the Client had attended.
6. NON-COMPLETION OF SERIES
If the Client does not complete the agreed upon amount of sessions within the series (refer Schedule A), the Client will still be liable for payment of the total amount as stated in Schedule A, unless agreed upon by the Counsellor with written acknowledgement. No refunds for monies paid are applicable, other than ones specifically offered in writing by the Counsellor. All payments must be made by the due date or the Counsellor may terminate the Agreement.
7. CLIENT – COUNSELLOR CONFIDENTIALITY
The Counsellor guarantees the Client that all information that is divulged during the Counselling Sessions will be held in strict confidentiality and in accordance with the Australian Counselling Association Code of Ethics, and within the limits set by the Law.
The Client understands that the power of the counselling relationship can only be granted by the Client and the Client agrees to be honest, precise and straight-forward in dealings with the Counsellor, for the best outcome.
The Client agrees that the information provided during the Counselling Session is for personal use only. The Parties’ signatures on this agreement indicate full understanding of, and acceptance of the information and terms set out above.
8. ACCEPTANCE OF TERMS OF AGREEMENT
I, the undersigned, am authorised to enter into this agreement on behalf of the Client and agree to the terms and conditions as stated in this Counselling Services Agreement, including the contents of Schedule A;
